Because the pending decision will leave numerous unresolved problems, the Congress of the United States is undertaking to develop new legislation which will directly affect tribal rights and the authority of tribal governments. WHEREAS; within the next few weeks the Supreme Court of the United States will render its decision on the nature and extent of fishing rights and the authority of Indian Tribes; and WHEREAS; elected representatives from Washington State have announced that they will introduce (and hold hearings concerning) legislation relating to Indian treaty fishing in the Congress of the United States; and WHEREAS; other actions of the Congress, the State of Washington and various regulatory agencies promise to affect the fishing right; and WHEREAS; the interests of tribal peoples in Washington can best be served through a well prepared and coordinated Effort, representing a mutually beneficial front to combat any threats to our sovereign fishing rights; NOW, THEREFORE, BE IT RESOLVED that tribal delegates to the Conference of Tribal Governments, Session III firmly support the develop- ment of a coordinated and unified approach to addressing the treaty fishing rights issue, including but not limited to: a. coordinating strategies for legislative action and public awareness, b. define existing efforts and point out possible duplica- tion of these efforts, c. A determination of the advisability of escalating the treaty rights issue beyond the confines of the judicial and legislative processes of The United States; and BE IT FURTHER RESOLVED that individual tribes identify and assess their resources, such as councilman, individual tribal members and staff who could be utilized in this coordinated approach; and BE IT FURTHER RESOLVED that a coordinating team be selected immediately to prevent duplication of effort and provide a unified format; and BE IT FURTHER RESOLVED that individual tribes be discouraged from pursuing independent actions which are detrimental to the interests of a unified and coordinated effort as it pertains to the sovereign fishing rights of Indian people. BE IT FURTHER RESOLVED that the tribal people of the State of Washington direct the Federal Trustee to act on behalf of a coordinated and unified effort on the tribal fishing rights question by financially supporting the above programs and methods.
